YooDrive Terms of Service and Platform Agreement

Free Access Summary:

YooDrive provides free access to a wide range of tools and features for both Driving Schools and Independent Instructors.

Free Access Includes:

  • Profile listings with verified DVSA registration
  • Calendar and diary management tools
  • Booking system with integrated cancellation protection
  • Automatic lesson slot outreach when cancellations occur, helping fill last-minute availability
  • School/Mentor level diary visibility, allowing schools/mentors to view team member schedules in real time
  • Review collection system compliant with GDPR and DMCC law requirements
  • Secure messaging platform between pupils and instructors
  • Access to pupil lead enquiries (subject to this term agreement)
  • Ability to invite and manage their own pupils
  • PDI mentorship tools (for instructors acting as schools)
  • Dashboard with Ai booking analytics and earnings tracking

No subscription fees apply for access to these core tools.

YooDrive only earns revenue when a pupil books a lesson that results from YooDrive’s own marketing efforts — such as advertising, search engine listings, or social media outreach. The 12% platform margin is paid by the pupil as part of the published price, not by the instructor or school, ensuring full platform access remains free for service providers.

This ensures a transparent and fair model:

  • If a pupil comes via YooDrive’s marketing, a 12% platform fee had previously been added from the School/Instructor base rate to create the published price, this fee is paid by the pupil, not the instructor or school. It is then fairly split between YooDrive and (where applicable) the school or the instructor.
  • This ensures that service providers never bear the cost of YooDrive’s platform and only benefit from the exposure and bookings our marketing delivers.
  • If instructors or schools invite their own pupils, YooDrive earns nothing — but still provides full access to all tools, messaging, analytics, calendar, payment and review systems.

There are no hidden charges, no subscriptions, and no cost whatsoever to instructors or schools, unless a booking is made with a pupil introduced through YooDrive’s marketing. In those cases, the platform earns its fee transparently formed as part of the published booking price.

This is a performance-based structure that keeps the platform free and fair for all instructors, schools, and pupils.

Pupils benefit by gaining access to a trusted, transparent, and scam-resistant platform. All instructors are verified against the DVSA register, reviews are only accepted from verified bookings, and pupil data is protected under the highest UK data protection laws. YooDrive simplifies the learning journey by ensuring fair pricing, safe communication, and a quality-assured experience for every pupil using the platform.


Pupil Consents and Instructor/School Protection is in place to ensure all users of YooDrive operate legally under the strictest UK data and consumer protection laws, pupils are required to provide specific, time-stamped consents before any messaging, bookings, or reviews can occur. These include:

  • ✅ Consent to Share Data with Assigned Instructors and/or Driving Schools – Pupils must allow YooDrive to share their details with both instructors and schools, where applicable, strictly for the purpose of booking and delivering lessons.
  • ✅ Consent to be Contacted by Instructors via Phone – Pupils opt in to share their phone number, which may be used by instructors strictly for lesson-related calls.
  • ✅ Consent for Dashcam Recording – If an instructor uses a dashcam, the pupil must consent prior to the lesson. This helps protect both parties in disputes.
  • ✅ Consent for Test Pass Photo Publication – Optional opt-in for pupils allowing instructors to use test pass photos in reviews or marketing.
  • ✅ Consent to Leave Reviews and Be Contacted Post-Booking – Pupils opt in to receive one-time review requests to ensure compliance with the DMCC Act 2024.

These consents:

  • Are recorded with timestamps and visible to instructors as green ticks or red crosses.
  • Comply fully with the UK GDPR, PECR, and Digital Markets, Competition and Consumers Act 2024 (DMCC).
  • Protect instructors and schools from unlawful contact, data misuse claims, or unsolicited marketing breaches.

Why This Matters:

Most instructors are not aware of their responsibilities under ICO and DMCC regulations. By using YooDrive, they are automatically protected against breaches by:

  • Gaining proof of lawful basis for contact
  • Ensuring transparent, reviewable permissions
  • Avoiding penalties for unlawful marketing or pupil image use

YooDrive’s system simplifies this legal burden by handling all consent collection, versioning, and visibility on behalf of instructors and schools. Pupils are never required to consent to marketing or image use — these options are entirely voluntary.

Unlike social media marketplaces, all listings are verified and reviews are only accepted from real bookings. This protects pupils from fake instructors and prevents fraudulent activity common on unregulated sites.


Definitions:

Base Rate: The lesson price set by the Instructor or School, before platform fees.

Published Price: The Base Rate plus the 12% platform fee, visible to Pupils.

Platform Fee: Our 12% fee added to the Base Rate, split between YooDrive and eligible Schools/Mentors.

Pupil: A learner driver using the YooDrive platform.

Mentored PDI: A (PDI) Potential Driving Instructor sponsored by an Instructor or School.

1. Introduction

YooDrive is a technology platform that connects learners with driving instructors and schools. YooDrive acts solely as an agent facilitating bookings and payments. All services are delivered by independent instructors or schools.


2. Jurisdiction and Law

This Agreement is governed by the laws of England and Wales or, where applicable, Scotland. Users based in Scotland may refer disputes to Scottish courts.


3. Independent Contractor

Relationship Instructors and Schools are not employees, agents, or subcontractors of YooDrive. They operate independently and accept full responsibility for their compliance with UK law, insurance, and DVSA regulations.


4. Consent and Data Responsibilities

Instructors and Schools are strictly prohibited from soliciting pupils introduced by YooDrive to transact outside the platform. This includes messaging, marketing, or conducting lessons through any other payment or booking method, unless the pupil was invited to the platform directly by the instructor.

Instructors and Schools must supply a valid ICO registration number upon signup and agree to use pupil data only for the purpose of delivering lessons via the platform. Data received from instructor-invited pupils remains linked to YooDrive’s platform, but such pupils may be ported by the inviting instructor upon account closure, subject to GDPR.


5. Platform Usage and Reviews

Only verified bookings completed through the platform are eligible for reviews. Reviews from unverified sources will not be published to prevent fraud. YooDrive may moderate review visibility based on score patterns or flagged reports but will provide a right of reply and 7-day appeal process.


6. Dispute Resolution

YooDrive acts as the first point of dispute resolution. If unresolved, parties may seek independent mediation or escalate to small claims court. YooDrive’s initial findings are non-binding beyond its platform but may result in account suspension or adjustments.


7. Payments and Fund Handling

Instructors and Schools are responsible for keeping their Stripe Connect and bank details up to date to avoid payout delays.

Payments may be delayed or cancelled if the instructor or school fails to maintain a valid and verified Stripe Connect account. YooDrive is not liable for delays caused by invalid bank details, Stripe suspensions, or other third-party payment issues.

Payments are processed via Stripe Connect and held separately from YooDrive’s operating funds. Instructors and schools are paid within 48 hours after the lesson is completed, unless under review. YooDrive does not guarantee payout in cases of chargebacks or fraud.


8. Commission Model and Platform Fees

  • Where instructors or schools onboard team members, such as PDIs, the revenue share and platform terms may auto-renew in alignment with continued platform use and active connections. Schools are responsible for ensuring their teams remain linked if they wish to retain revenue share continuity.
  • Schools input a base rate; a 12% platform fee is added to form the published price. Stripe fees are split 50/50. Margin split: 7% to school, 5% to YooDrive (gross).
  • Independent instructors set the base rate. A 12% fee is added; YooDrive covers Stripe fees. Instructor receives base rate.
  • Instructor-invited pupils: YooDrive takes no fee; the instructor pays the Stripe fee.
  • Mentorship model: Instructors mentoring PDIs are treated like schools. The 7% / 5% margin split applies. Stripe fee shared 50/50.

9. Termination and Suspension

Either party may terminate the agreement with 14 days’ notice. In the event of serious misconduct (e.g. fraud, abusive behaviour, regulatory breach), YooDrive may suspend or terminate accounts immediately.


10. Updates to Agreement

YooDrive may update this Agreement with at least 30 days’ notice. Users will be notified via email or in-app message. Continued use of the platform after notice constitutes acceptance. Material changes may require re-consent.


11. Mutual Indemnity

Each party agrees to indemnify the other against losses arising from gross negligence, data breaches, or unlawful conduct within their control.


12. Limitation of Liability

YooDrive’s liability is capped at the total commission earned from the affected booking. YooDrive is not liable for service failures caused by instructors, technical outages, or force majeure.


13. Reviews and Listings

Instructors listed via the DVSA’s Open Government Licence will be clearly marked as “unclaimed.” They may request removal by proving identity. All claimed listings require active agreement to platform terms.

15. Entire Agreement

This Agreement may be accompanied by a simplified, plain-English summary for ease of understanding by users. In the case of conflict, this full legal version shall prevail.

This Agreement replaces all prior oral or written agreements between the parties and constitutes the full understanding relating to platform use.
